I wonder if a Constitutional case could be made against mail-in balloting based on the 14th Amendment. My argument would consist in the observation that a fraudulent ballot effectively cancels my own vote, depriving me of my Constitutionally guaranteed right to be represented through participating in the electoral process.
Mail-in ballots do not require proof of identity, and thus voter fraud becomes vastly easier. Dead people who have intentionally not been erased from the voter rolls–which Democrats refused to allow Pence to audit in the aftermath of the 2016 election–and people who don’t normally vote can have ballots filled out in their names, by Democrats who have spent the past four years building lists of names. In States like California which actively facilitate cheating by not really trying to keep accurate, valid lists of names, people not even in this country legally can vote, and also invalidate the votes of the rest of us who ARE here legally, and for whose benefit the system exists.
The same argument could be made for voting without Voter ID, which is universal the world over. The poorest Indians, who live in ramshackle huts, with dirt floors and no plumbing, are required to have ID.
And reading the 14th Amendment, it provides that the “basis of representation” be reduced in States where voter disenfranchisement is perpetrated. Could States where the Attorney General or equivalent fails to properly prevent fraud (California) be punished by having their number of Representatives to the House reduced? I think the law could certainly be read that way. The system as a whole depends on the honesty of the parts, and successful fraud tends to become self perpetuating, since it acts to ensure its own continuance by making sure people supporting the fraud continue to win unfair elections whose on-going continuation they make a matter of semi-official policy. Think Tammany Hall on a State or even national level. Graft for graft, never prosecuted because the criminals run the police too.
Imagine a situation where California had a quarter of their Representatives culled from the House for 2 or 4 years. It would be beautiful. And this threat, on the table, might help.
My gut instinct is that the Democrats have a threshold above which cheating is riskier than chancing a fair outcome. My gut tells me they can swing about 5 million illegal votes nationally, which is a lot. If Trump wins by more than that–which is quite possible, given how horrifically the Democrats have been treating the American people and how insulting Joe Biden is to the intelligence of Americans as a non-viable candidate who should never have been put forth for the office of President of the United States–then the election chaos the Democrats plan will be obvious to all as a farce, a gross insult, and a de facto insurrection and attempted coup, with following legal consequences, which I would hope would include arrests and prosecutions of its ring leaders.
Please continue to pray for this nation, and indeed the future of humankind. This time is pregnant with both large risk and enormous potential for good.
